Key Responsibilities:
Pre-contract review, negotiation and drafting of NEC, FIDIC, EPC/EPCM Contracts and general subcontract, supply, services and purchase agreements.
Post-contract claims and dispute management arising from time to time during project execution involving extension of time, Force Majeure, and scope variation claims.
Post-contract award administration activities, assessment of extra work authorisations & claims, direct supplier liaison & generally, all other activities associated with the administration of Electrical, Mechanical, Structural and Civil related contracts under an EPC/EPCM authority.
Drafting of contractual correspondence while rapidly assembling and distributing contractual notices (including claims, impact notices, and early warning notices).
Timeously adapted schedules to incorporate any changes arising from correspondence, claim notices, performance guarantees, and retention to mitigate unsolicited risks.
Collaborate closely with the Commercial Manager and cross-functional teams including Supply Chain Management (SCM) to ensure effective contract administration and compliance.
Supervise existing resources and potentially manage additional contract administrators in the future.
Demonstrate expertise in commercial contracts, particularly within the construction sector, with a deep understanding of EPCM processes.
Manage cross-border transactions, Inco terms, and risk management strategies.
Engage with key stakeholders including Legal, Commercial, SCM, end-users, and business partners to align contract strategies with organizational objectives.
Take ownership of tasks, provide guidance and advice on contract-related matters, and ensure timely completion of deliverables.
Demonstrate proactive leadership by anticipating challenges, identifying opportunities for improvement, and making informed decisions independently.
Qualifications and Experience:
A legal degree is preferred, with a minimum of 7-10 years of post-qualification experience in contract management.
Extensive knowledge of construction contracts such as NEC, FIDIC, EPC, and EPCM-related agreements.
Familiarity with FIDIC and related contracts is highly desirable.
Previous site-related experience will be advantageous.
Proven track record of managing complex commercial contracts, preferably within the mining or related industries.
Experience in negotiating and drafting agreements for mega projects with significant financial implications.
Strong understanding of international trade laws, regulations, and best practices.
Excellent communication, negotiation, and interpersonal skills.
Ability to lead and inspire teams, fostering a culture of collaboration and excellence.
Proficiency in relevant software and tools for contract management.
